1. About FYLLR

FYLLR is a technology-enabled marketplace platform operated by Cara Latham (ABN: 46 160 848 794), trading as FYLLR, that connects clients seeking last-minute beauty and wellness appointments with independent beauty and wellness service providers ("Partners") in Melbourne, Victoria.

FYLLR provides the technology platform, discovery tools, and booking infrastructure. FYLLR does not itself provide any beauty, wellness, grooming, or related services. All services listed and delivered through the platform are provided solely and exclusively by the Partners, who are independent third-party businesses and sole traders operating independently of FYLLR.

2. Definitions

In these Terms & Conditions:

3. Eligibility

3.1 Age

You must be at least 18 years of age to register and use FYLLR. By creating an account, you represent and warrant that you are 18 or older. FYLLR does not knowingly collect information from individuals under 18.

3.2 Clients

Clients must be natural persons accessing the Platform for personal use. Bookings may not be made on behalf of another person without their knowledge and consent.

3.3 Partners

Partners must hold all licences, registrations, permits, and qualifications required by applicable law to offer the services they list on the Platform, including any requirements under Victoria's Business Licensing Authority Act 1998 or applicable health and hygiene regulations. By registering as a Partner, you represent and warrant that you hold and will maintain all such authorisations throughout your use of the Platform.

4. Account Registration

4.1 Accurate information

You must provide accurate, current, and complete information when registering. You agree to update your account information promptly if anything changes.

4.2 Account security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify FYLLR immediately at info@fyllr.app if you suspect any unauthorised access to your account.

4.3 One account per person

Clients may hold one account. Partners may hold one Partner account per registered business entity. Creating duplicate or fraudulent accounts is prohibited.

4.4 Acceptance of terms

By registering, you confirm you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy. Your acceptance is recorded along with a timestamp and the IP address from which you registered, and is stored against your account.

5. FYLLR's Role as a Platform Intermediary

ImportantFYLLR is a technology marketplace platform only. We do not employ, supervise, direct, or control Partners, their staff, or the services they provide. All beauty and wellness services are provided solely by Partners, who are independent third-party service providers.

5.1 No service provider

FYLLR is not a beauty or wellness service provider. The availability of a Partner on the Platform does not constitute a recommendation, endorsement, or guarantee of that Partner's services, qualifications, suitability, or professionalism by FYLLR.

5.2 No employment relationship

Nothing in these terms creates any employment, agency, partnership, joint venture, or franchise relationship between FYLLR and any Partner. Partners are independent contractors who set their own prices, hours, availability, and service standards.

5.3 No quality guarantee

FYLLR makes no representation, guarantee, or warranty as to the quality, safety, accuracy, fitness for purpose, or outcome of any service listed or delivered by a Partner. All services are booked and received at the Client's own discretion and risk.

5.4 Third-party contracts

When a Client makes a Booking, the contract for the provision of services is formed directly between the Client and the Partner. FYLLR is not a party to that contract.

6. Client Terms

6.1 Free to use

Clients may use FYLLR at no charge. FYLLR does not charge Clients booking fees, service fees, or commissions.

6.2 Booking responsibility

Clients are responsible for reviewing Partner profiles, service descriptions, pricing, and reviews before making a Booking. By completing a Booking, you agree to attend the appointment at the time and location specified and to pay the Partner's stated price directly to the Partner.

6.3 Payment to Partners

Payment for Services is made directly between the Client and the Partner. FYLLR does not process, hold, or facilitate payment for individual service transactions. Partners are solely responsible for their own payment arrangements.

6.4 Conduct toward Partners

Clients agree to treat Partners and their staff with respect. Aggressive, abusive, threatening, or discriminatory behaviour toward Partners is grounds for immediate account suspension.

6.5 Accuracy of personal information

Clients must provide accurate information when making bookings, including any relevant health information requested by Partners prior to a service. Failure to disclose relevant health conditions may place you at risk and relieves FYLLR and the Partner of liability for adverse outcomes directly caused by that non-disclosure.

7. Partner Terms

7.1 Subscription

Partners access the Platform via a flat monthly subscription fee of $38.50 AUD per month (inc. GST), billed through Stripe. The first two months are provided free of charge as a founding benefit ("Founding Period"). After the Founding Period, billing commences automatically unless you cancel prior to the end of the second month.

7.2 Service revenue

Partners retain 100% of all revenue received from Clients for services delivered. FYLLR does not take commission on individual service transactions.

7.3 Listing accuracy

Partners must ensure all listings, pricing, availability, service descriptions, and images are accurate, current, and not misleading. You must not list services you are not qualified or authorised to perform. FYLLR reserves the right to remove inaccurate, misleading, or inappropriate listings at its discretion.

7.4 Licences and compliance

Partners must at all times hold valid licences, registrations, and insurance appropriate to the services they offer, including public liability insurance. FYLLR may request evidence of relevant licences or insurance at any time and may suspend or remove a Partner who cannot demonstrate compliance.

7.5 Health and hygiene

Partners are solely responsible for ensuring their services are delivered in compliance with all applicable health, hygiene, infection control, and workplace safety laws and regulations in Victoria, including those administered by the Department of Health and local council health requirements for beauty premises.

7.6 Professionalism

Partners represent that they and their staff will behave professionally, respectfully, and in accordance with applicable consumer protection law when dealing with Clients.

7.7 Content submitted

By submitting content (images, descriptions, pricing) to the Platform, you grant FYLLR a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Platform.

7.8 Cancellations and no-shows

Partners must maintain reasonable cancellation policies that are clearly stated in their listing. Partners who habitually cancel confirmed Bookings or engage in deceptive availability practices may have their account suspended or removed.

8. Bookings and Cancellations

8.1 Confirmation

A Booking is confirmed when you receive written confirmation from FYLLR via the Platform or by email. Until that confirmation is received, no Booking has been made.

8.2 Client cancellations

Clients may cancel Bookings subject to each Partner's cancellation policy as displayed on their profile. FYLLR is not responsible for and has no authority over the cancellation fees or conditions set by individual Partners.

8.3 Partner cancellations

Partners are expected to honour confirmed Bookings. In the event a Partner must cancel, they are responsible for notifying the Client as early as possible and, where appropriate, offering an alternative appointment.

8.4 No-shows

Clients who repeatedly fail to attend confirmed Bookings without notice may be suspended from the Platform. Partners who repeatedly cancel or fail to honour Bookings may also be suspended or removed.

8.5 FYLLR's role in disputes

FYLLR may, at its sole discretion, attempt to facilitate communication between a Client and a Partner where a dispute arises from a Booking. FYLLR is not obligated to resolve disputes and is not a party to the service contract between the Client and Partner.

9. Payments and Billing

9.1 Partner subscription billing

Partner subscription fees are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. By providing payment details, you agree to Stripe's Terms of Service and Privacy Policy, available at stripe.com/au/legal. FYLLR does not store full payment card details.

9.2 Automatic renewal

Unless cancelled at least 24 hours before the end of a billing period, subscriptions renew automatically at the then-current rate. You authorise FYLLR to charge your nominated payment method each billing cycle.

9.3 Failed payments

If a payment fails, FYLLR will attempt to re-process the charge. If payment cannot be collected, access to the Platform may be suspended until outstanding fees are paid.

9.4 Refunds

Subscription fees are generally non-refundable. If you believe a charge was made in error, contact us within 14 days at info@fyllr.app.

9.5 GST

All partner subscription fees are GST-inclusive. The subscription fee is $38.50 AUD per month (inc. GST).

9.6 Price changes

FYLLR may adjust subscription pricing with at least 30 days' written notice to Partners. Continued use of the Platform after the effective date of a price change constitutes acceptance of the new pricing.
