and
The Partner
The business or individual who accepts this Agreement upon completing the Fyllr partner onboarding process.
(Partner, you)
By completing the onboarding process and activating a Partner account on the Fyllr platform, the Partner agrees to be bound by the terms of this Agreement. This Agreement is governed by the laws of Victoria, Australia.
1. The Platform
Fyllr is a last-minute beauty and wellness marketplace that connects clients seeking same-day or short-notice appointments with Partner studios and practitioners in Melbourne.
Fyllr provides Partners with access to the platform to list available appointment slots, receive booking requests from clients, and manage their presence on the marketplace.
Fyllr operates as a marketplace only. We are not a party to the service agreement between the Partner and the client. The Partner is solely responsible for delivering the services booked through the platform.
2. Client Data and Relationships
2.1 Fyllr's role
Fyllr holds the client relationship on the platform. We collect and manage client data in accordance with our Privacy Policy and the Australian Privacy Act 1988.
2.2 What Partners receive
Upon a confirmed booking, Partners receive the client's name and appointment details necessary to deliver the booked service. Client email addresses are not passed to Partners by default.
2.3 Client opt-in to Partner communications
At the time of booking, clients may opt in to receive direct communications from the Partner. Where a client opts in to a specific Partner, that Partner may receive the client's contact details and may market to them directly. Partners must handle any such data in accordance with the Australian Privacy Act 1988 and the Spam Act 2003.
2.4 Restrictions on Partner marketing
Partners must not independently market to Fyllr-sourced clients who have not opted in to their communications. Partners must not add Fyllr-sourced client contact details to third-party mailing lists or CRM systems without the client's explicit consent.
2.5 Fyllr's use of client data
Fyllr uses client activity data to operate and improve the platform, send marketing communications, and drive bookings. Fyllr does not use Partner business data (including service mix, pricing or performance metrics) for benchmarking, third-party recommendations, or developing competing offerings.
2.6 Data export and deletion
Partners may request a full export of their booking history and opted-in client data at any time by contacting info@fyllr.app. Upon cancellation of this Agreement, Fyllr will provide an export on request and delete Partner data from our systems within 30 days.
3. Bookings and Cancellations
3.1 Booking requests
Bookings on Fyllr are requests. When a client makes a booking request, the Partner receives a notification and must confirm or decline. A booking is only confirmed once the Partner accepts the request.
3.2 Availability
Partners are responsible for keeping their availability on Fyllr accurate. Partners should only list slots that have not been committed to other platforms or clients. Fyllr is not liable for double bookings caused by inaccurate or outdated availability.
3.3 Cancellation policy
Each Partner must upload their own cancellation policy during onboarding. This policy is displayed to clients at the time of booking, and clients must agree to it before a booking can be confirmed. The Partner's cancellation policy governs all disputes relating to cancellations, late changes and no-shows. Fyllr is not responsible for enforcing or mediating cancellation disputes between Partners and clients.
3.4 SMS reminders
Fyllr sends automated SMS reminders to clients ahead of confirmed appointments as a platform service. These reminders are provided as a courtesy and do not constitute a guarantee of client attendance. Fyllr is not liable for no-shows where reminders were sent.
4. Commercial Terms
4.1 No commission
Fyllr charges no commission on bookings. Clients pay Partners directly for services delivered. Fyllr has no involvement in the payment for services between clients and Partners.
4.2 Subscription fee
Access to the Fyllr platform is subject to a monthly subscription fee of $38.50 per month (inc. GST), billed monthly via Stripe.
4.3 Free period
Partners who join before 7 February 2027 receive a free subscription period until 7 April 2027. No subscription fee is payable during this period regardless of booking volume.
4.4 Post free period billing
From 8 January 2027, the monthly subscription of $38.50 (inc. GST) will be charged to the payment method provided at onboarding. Fyllr will notify Partners by email before the first charge is applied.
4.5 No exclusivity
This Agreement does not create exclusivity. Partners may list on other platforms and booking systems simultaneously.
4.6 Stripe fees
Fyllr absorbs Stripe processing fees during the founding free period. Fyllr reserves the right to review this arrangement when standard subscription billing commences.
5. Partner Obligations

7.2 Limitation of liability
To the maximum extent permitted by law, Fyllr's total liability to a Partner under or in connection with this Agreement is limited to the total subscription fees paid by that Partner in the three months preceding the event giving rise to the claim.
7.3 No liability for missed bookings
Fyllr does not guarantee any volume of bookings and is not liable for loss of income arising from low or zero booking volume.
7.4 Platform availability
Fyllr will use reasonable endeavours to keep the platform available but does not guarantee uninterrupted access. Fyllr is not liable for losses arising from platform downtime or technical issues.
7.5 Disputes between Partners and clients
Any dispute between a Partner and a client regarding a booking, service delivery, cancellation or refund is a matter between the Partner and the client. Fyllr may, at its discretion, assist in mediating disputes but is not obliged to do so and is not liable for the outcome.
8. Term and Termination
8.1 Term
This Agreement commences on the date the Partner completes onboarding and continues on a month-to-month basis until terminated.
8.2 Cancellation by Partner
The Partner may cancel their account at any time with no notice period required. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
8.3 Termination by Fyllr
Fyllr may suspend or terminate a Partner's account immediately if the Partner:
- Breaches any term of this Agreement
- Delivers services in a way that is unsafe, illegal or harmful to clients
- Repeatedly fails to honour confirmed bookings
- Acts in a way that is reputationally damaging to Fyllr
Fyllr may also terminate this Agreement with 30 days written notice for any other reason.
8.4 Effect of termination
On termination, the Partner's access to the platform ceases. Fyllr will provide a data export on request and delete Partner data within 30 days as set out in clause 2.6.

This Agreement is governed by the laws of Victoria, Australia. Any disputes arising under this Agreement are subject to the exclusive jurisdiction of the courts of Victoria.
9.4 Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.
